The Chief objection of the Court to these rules is that when you take them as a whole & you cannot admit that they are such rules framed, any infraction of which may be furnished by a fine of $200, and in default of payment by one month's imprisonment.
When the Legislature in Sec. XII spoke of framing rules and regulations and enacted the above penalty, did it contemplate such rules as that on page 13, No. 29 respecting the duty of an Inspector receiving a letter from the Superintendent; or that at page 61, l.08 respecting the attendance of Constable at a place of worship; or that at page 67, No. 44 respecting the duties of the Constable in the Gardens, respecting awahs allowing children to obey calls of nature in public parts of the Gardens? These instances could easily be multiplied.
This is what the Court means by saying that this book could not be received in evidence as it did not contain such rules and regulations as one would expect to be framed under the Ordinance. They may be a complete code of Instructions for the guidance of all members of the Police Force, but the Court refuses to admit them as the orders and regulations required by Section 13 of the Police Ordinance.
It is therefore necessary that Rules and Regulations should, without any delay, be framed by the Captain Superintendent of Police in compliance
